1. Acceptance

By downloading or playing Mortal Ascend ("the Game"), you agree to these Terms of Service ("Terms"). If you do not agree, do not play the Game.

2. Eligibility

You must be at least 13 years old (16 in the EU). Players under 18 must have parental consent for any purchases.

3. Your Account

One account per device family unless we authorize otherwise.
Do not share, sell, or transfer your account.
We may suspend or terminate accounts that violate these Terms (cheating, fraud, abuse).

4. In-App Purchases & Virtual Items

All purchases are processed by Apple, Google, or Telegram.
Virtual items (gems, summons, characters) have no real-world value and are non-refundable except as required by law.
Gacha Disclosure: All summon probabilities are publicly disclosed in-game (Settings → Gacha Odds) and at https://mortalascend.com/gacha-odds.
We may modify or remove virtual items, characters, or game mechanics for balance or legal reasons with reasonable notice.

5. Code of Conduct

You must not:

Cheat, exploit bugs, use bots / scripts / unofficial clients
Engage in real-money trading of accounts or items
Harass, threaten, or impersonate other players
Upload offensive, illegal, or copyright-infringing content
Reverse-engineer or attempt to access non-public APIs

6. Service Availability

The Game is provided "as is". We strive for 99% uptime but cannot guarantee uninterrupted service. Scheduled maintenance will be announced 24h in advance.

7. Game Closure Policy

If we decide to discontinue the Game, we will:

Announce 90 days in advance
Stop selling new virtual items 30 days before shutdown
Offer in-game compensation where applicable
Refund unspent purchases made in the 90 days before announcement (jurisdiction permitting)

8. Intellectual Property

All game content (art, code, characters, story, music) is owned by NDUP Studio or our licensors. You receive a limited, non-transferable, non-exclusive license to use the Game for personal entertainment.

9. User Content

Anything you post in chat or guild messages: you retain ownership; you grant us a license to display, store, and moderate it within the Game.

10. Limitation of Liability

To the maximum extent permitted by law, our total liability is limited to the amount you paid us in the 12 months before the claim, or USD 50, whichever is greater. We are not liable for indirect, incidental, or consequential damages.

11. Governing Law & Disputes

These Terms are governed by the laws of Hong Kong. Disputes will first be addressed via mutual negotiation; unresolved disputes go to arbitration in Hong Kong (small-claims court exception preserved).

12. Changes

We may update these Terms. Material changes will be announced in-game 30 days before taking effect. Continued play after that constitutes acceptance.

5. 行为准则

不得：

外挂、利用 BUG、使用脚本 / 机器人 / 非官方客户端
进行账号或道具的真钱交易
骚扰、威胁、冒充他人
发布违法、侵权或低俗内容
逆向工程或访问非公开 API

6. 服务可用性

本游戏按"现状"提供。我们追求 99% 可用率但不保证不间断服务。计划维护将提前 24 小时公告。

7. 停服政策

若我们决定停止运营，将：

提前 90 天公告
停服前 30 天停止销售新虚拟道具
视情况提供游戏内补偿
在司法辖区许可范围内，对公告前 90 天内未消耗的充值予以退款

8. 知识产权

所有游戏内容（美术、代码、角色、剧情、音乐）归 NDUP Studio 或我们的许可方所有。您仅获得有限的、非转让的、非独家的个人娱乐许可。

9. 用户内容

您在聊天 / 公会消息中发布的内容，所有权归您；您授权我们在游戏内展示、存储与审核。

10. 责任限制

在法律许可最大范围内，我们的总责任不超过您在主张前 12 个月内支付的金额或 50 美元（取较高者）。我们不对间接、偶然或后果性损害负责。

11. 法律适用与争议

本条款适用 Hong Kong 法律。争议优先协商解决；不能解决的提交 Hong Kong 仲裁（保留小额法庭例外）。

12. 变更

我们可能更新本条款。重大变更将提前 30 天在游戏内公告。之后继续游玩视为接受。
